Cryptocurrency Regulation in India: The Country Lags Behind Global Rules but Increases Oversight

0 Reading time: 7 min. Сoinspot

cryptocurrency regulation in India is developing cautiously: India has not yet adopted a comprehensive law for virtual digital assets, but already uses tax rules, anti-money laundering regulations, and ongoing market oversight.

Cryptocurrency Regulation in India: The Country Lags Behind Global Rules but Increases Oversight

Against the backdrop of more active measures by other major jurisdictions, the Indian approach appears restrained. Cryptocurrency in the country is not completely banned: authorities are not shutting down the sector, but are also not rushing to grant it clear legal status. As a result, the market operates under partial control: users and companies see working rules for certain areas, but there is still no overall framework.

  • Taxes: India already uses tax rules as a tool to control digital asset transactions.
  • Transaction monitoring: the market operates under constant supervision, and companies must more carefully track clients and deals.
  • AML: anti-money laundering measures have become one of the main pillars of the Indian approach.
  • Key risks for market participants are legal uncertainty, possible restrictions on banking services, and the lack of clear investor protection.
  • The return of Coinbase and the resumption of rupee deposits are testing how sustainable the current regulatory model will be.
  • The Reserve Bank of India opposes the legalization of virtual digital assets, while the Institute of Chartered Accountants of India supports a clearer law for compliance.

The Return of Coinbase Became a Test for Indian Crypto Policy

Interest in the Indian market increased after the return of Coinbase. At India Blockchain Week, Coinbase Asia-Pacific director John O’Loghlen called the country the “North Star” for the exchange. This signal came at a time when the platform is once again focusing on local users and giving them access to deposits in Indian rupees.

For centralized platforms, this step is important: easy entry into the market through the national currency can support demand for the online digital currency exchange service and simplify the purchase of crypto assets. But uncertainty remains the main limiting factor. Until the rules are brought into a single system, any transaction with digital assets requires companies to pay especially close attention to compliance.

This situation affects not only Coinbase. Major players like Binance also have to adapt their operations to Indian requirements for oversight, taxes, and user verification. For them, the main thing is to show that transactions are carried out in accordance with local rules, even if there is not yet a comprehensive unified framework for the crypto market. For investors, this means that investments in Bitcoin, blockchain tokens, or other digital assets depend not only on market prices, but also on how the authorities interpret transactions with them.

Why India Is in No Hurry for a Comprehensive Law

The main feature of the Indian model is that the country regulates specific risks without granting the sector full legal recognition. Tax rules, monitoring requirements, and anti-money laundering measures are already in effect.

For crypto companies, this means daily work with basic procedures:

  • building compliance procedures;
  • verifying clients before granting access to transactions;
  • complying with KYC and AML principles;
  • monitoring transactions and being ready to confirm compliance.

If these processes are weak, companies face a higher risk of claims from regulators and service restrictions.

The Reserve Bank of India opposes the legalization of virtual digital assets.

This position sets the tone for the entire regulatory model. The financial regulator remains cautious: the digital market is growing rapidly, but authorities are not ready to equate it with traditional instruments without additional guarantees. For crypto companies, this approach is especially sensitive: banking services and access to settlements depend on how cautiously banks treat digital asset transactions.

The issue is also complicated for accounting. For businesses, it is important to understand which category to assign a crypto asset to: it is not a traditional currency, not a usual company share, and not an asset with a fully established legal regime. Therefore, companies have to be especially careful in describing accounting policies, valuing digital assets, and reflecting related transactions.

What This Means for the Market

The Indian strategy may support basic oversight, but it restrains rapid growth. The return of Coinbase shows that the market remains attractive, especially given the large number of potential users and interest in digital finance. However, the lack of a comprehensive law limits optimism: businesses need clear rules, and users need predictable protection.

For now, India is choosing an intermediate path. It is not ignoring the crypto market, but is also not rushing to legalize virtual digital assets. That is why cryptocurrency regulation in India remains one of the most closely watched stories in the global race for digital finance rules.
